Contingent Fee Explained

Attorneys that handle certain types of cases like malpractice, personal injury, etc. will often advertise that “they don't get paid if you don't get paid.” This is an example of a contingent fee agreement. Basically, the lawyer funds the cost of litigation primarily himself or herself and then takes somewhere around 33% or more for themselves when the case is settled or judgment is granted in favor of the lawyers client. This is allowed to allow those people that could not normally afford legal representation to have their day in court. Though the percentage the attorney takes may look high, remember that the attorney is paying the costs up front and bears all the risk of loss.
